Serious accidents punishment act.
Among OECD member nations, Korea has a high rate from industrial accidents. Fatal industrial accidents keep occurring, and they've become a major social issue.
The Serious Accidents Punishment Act is a law that places the burden of responsibility on the management. It is aimed at securing the safety and welfare of everyone in a workplace environment. The law specifies that people can be punished if a major industrial accident takes place becuase they shirk their duty. Excluding workplaces with fewer than five workers, the Act has been in effect since January, 2022.
In this context, a major industrial accident is an industrial accident in which one or more people are killed. It also includes cases where two or more workers require medical care for longer than six months because of a single accident.
OECD 회원국 가운데 우리나라는 산업 재해 사망률이 최상위권입니다. 산업 재해 사망 사고가 꾸준하게 발생하면서 중대한 사회적 문제로 대두되고 있습니다.
중대 재해 처벌법이란 경영 책임자에게 의무를 부과한 법류로, 사업장에서 일하는 모든 사람의 안전 및 보건을 확보하는 것이 목적입니다. 이 법에는 누군가가 의무를 다하지 않아 중대 산업 재해가 발생하면 처벌을 받을 수 있다고 명시되어 있습니다. 근로자가 5인 미만인 사업장을 제외하고, 2022년 1월부터 이 법률이 시행되었습니다.
여기서 중대 산업 재해란 1명 이상의 사망자가 발생한 산업 재해를 말합니다. 또한 동일한 사고로 6개월 이상 치료가 필요한 근로자가 2명 이상 발생한 경우도 이에 해당합니다.
